In this week's orders (2/10/12), the Texas Supreme Court granted no new cases, but did issue one new opinion. Click here to see the weekly order list.
In the new opinion (In re Nestle USA, Inc.), the court held that it did not have jurisdiction to consider the relator's challenge to the state franchise tax, because the relator did not pay the taxes under protest or request a refund from the Comptroller, which are statutory prerequisites to suit.
