The audio and transcript from Tuesday's arguments in the Supreme Court can be found here. I have listened to the arguments and I echo others' sentiments that Paul Clement did a masterful job.
Not surprisingly, the questions at argument indicate that the decision will come down to Justice Kennedy. He expressed a great deal of concern about finding some limiting principle. He also seemed worried about individual liberties and the individual's relationship to the government. Justices Alito's and Scalia's were more critical of the government's position. Questions by Justices Ginsburg, Breyer, Sotomayor, and Kagan were more friendly to the government. Chief Justice Roberts seemed more critical during the government's argument, but did ask some pointed questions to the opponents of the law. Justice Thomas, of course, did not ask any questions, but it is widely assumed based on his opinions in prior cases that he is opposed to expanding the government's power.
