Today, the Fifth Circuit ordered en banc rehearing in the case challenging the legality of a Farmers Branch ordinance that requires all adults seeking to rent housing in the city to establish that they are in the United States legally. The district court permanently enjoined enforcement of the ordinance on the ground that it was preempted by federal law. A panel of the 5th Circuit affirmed. 675 F.3d 802 (5th Cir. 2012).
